You're right, a lot of it is just that, making sure the vendor is invulnerable to lawsuits. In some cases it gets too extreme though, how do you make a software vendor take
responsibility for their software?

That's an excellent point. The problem is that software vendors expect that clicking "Agree" makes it a legally binding agreement when at least 70% of the time (I made that statistic up), people aren't even reading the agreements. I had to read a couple of them these last few days and I STILL don't understand them.
They might be well-intentioned, but they're not giving the customer any
choice.
