It depends on where you get them from. That, and the fact that Toshiba suddenly showed a huge drop in prices when the new Samsung distributors came into the market, and that most of HP's batteries and chargers are getting messed up before the first warranty year is over.

i have owned a hp before and the performance was good, but the durability with bad

HP = High performance + Lower price + noob durability,
Toshiba = High performance + Higher price + IMBA durability.
Verdict: Toshiba. (Pay the extra for the same HP performance and save yourself some serious headaches).

I think they are both very good and same level of quality, it just depends on luck and if the laptop is from a high-end line or entry-level ;)
I had an Acer for 4 years and it never get ill, my actual Toshiba is only 2 years old and has already the battery depleting in 30 mins, I think it's a recuring problem with all Toshiba
