The general consensus a long time ago was that if you didn't play the game online then your safe (even if your console was flashed/modded)
However, after the boom in the work with the JTAG and the New Glitch consoles over the past 2,3 years there is evidence that the xbox NAND communicates with MS every time on startup - it sends like a status report on system status AND history.
Of course this history will include any game you played; it is believed that if you play a incorrectly burned game (even offline) it will "flag" your console and modded, and basically that will send a "bad message" back to MS. Whether or not you get banned for it, still its not so sure.
The WORST thing i can think of MS doing is what they did in the last "banwave" - what they did is completely lock me out of my HDD so any DLC or even game installs i had on the HDD will corrupt if i tried transferring them or using them. Plus i couldnt store any other games or anything - this was fixed later by a mess up that MS did; when i once updated the dashboard again offline it unlocked everything lol.
So yeah; do it at your own risk, basically - then again the chances that you've used an incorrectly burned game are quite low, so don't worry so much.
Devil'sAdvocate wroteif your LT+3.0,there is no chance of you getting banned,just go to Google News and type Xbox 360,if you find out that there is some bans going on,disconnect for a couple of days.
I disconnected for a month in advance and still got banned so yeah. It isn't a "Live" banning process, your console gets flagged i.e. deemed to be banned, and you get taken down during a "wave" where MS turns on a "switch" and bans all the consoles flagged in that time period.
